I claim that one of the main focuses of my practice is to help Florida consumers create sustainable financial futures for themselves. In fact, the slogan that my firm uses publicly is “solutions for a sustainable future.” In this context, I define sustainability as the ability to maintain financial stability indefinitely. In other words, the ability to pay your bills, take care of reasonable needs, and not be completely broke at the end of every month. A balance, if you will.
For many, the thought of filing for bankruptcy signals thoughts quite the opposite of sustainability.
Many people feel that having to resort to bankruptcy is akin to personal failure and because of that they continue to suffer through significant financial and emotional distress much longer than necessary. They feel that bankruptcy is the end of the road and signals total personal defeat and financial ruin. This is simply not true.
The reality is that bankruptcy exists for a reason.
I counsel all my potential bankruptcy clients to view bankruptcy not as a failure, but rather as the springboard to a manageable financial situation. If your finances are left in the red each month after you adjust your budget as much as realistically possible, at some point something has to give. There is simply no sustainability in such a situation. Without the use of a mechanism such as bankruptcy, some people would simply never get to a point where they can meaningfully take control of their outstanding debts.
For many, bankruptcy is the single best tool that works to balance out their financial troubles in a meaningful way.
For some, it is but one piece of a more comprehensive approach to restructuring their obligations and their overall consumer habits. The goal in both cases is the same for the clients I counsel and represent – sustainability. Read in this context, bankruptcy is not a failure nor something to be ashamed about. Rather it is a tool to be utilized to take control of otherwise unmanageable financial obligations and pave the way to sustainability.
I firmly believe that individuals who are filing for bankruptcy should focus their time and effort on actively shaping their futures as opposed to rehashing and reliving the issues which caused them to need to file in the first place.
I believe that when people utilize bankruptcy appropriately and strategically, they lay the foundation for a future where they can achieve stability and sustainability in their financial lives.
