Beginning November 1, 2019 and current through the date of this blog post, the median income data has been updated by the U.S. Census Bureau. The figures have increased for Florida, which means that more persons may qualify for bankruptcy filing. The new median income figures for Florida are as follows:

Household Size

Median Income

1

$50,641

2

$61,619

3

$67,717

4

$81,091

5

$90,091

6+

+$9,000 per individual

Every person (or couple) who files for bankruptcy must make certain disclosures regarding their income for a period of time prior to filing. This information is used to determine whether the individual (or couple if filing jointly) must take the means test to determine income eligibility (in chapter 7) and whether the repayment plan will be 36 or 60 months (in chapter 13).

If your income is below the median income based on your family size, you do not have to take the means test to qualify for the income requirements of a chapter 7 bankruptcy.

If your income is above the median based on your family size, you still may qualify for a chapter 7 but you will need to take the means test in order to determine final eligibility. This is something that I would recommend you speak with an attorney about as the means test is not a straightforward process for most debtors.

If you are a Central Florida resident considering bankruptcy, Call 407-984-5270 today to schedule a free consultation so that we can discuss how I can help you take control of your situation and create a sustainable financial future for yourself.

(The calculation regarding the size of your household can vary from area to area, and the answer to this question is dependent on your specific situation. This is something that you will want to speak with your attorney about.)

I do everything in my power to provide options that my clients didn't even know existed before consulting with me.
